We're trying to keep this simple, but our lawyers told us we had to put some text together for you to read.
First, everything on our platform, including this Challenge, is governed by our Privacy Policy and Terms of Use. These documents lay out the dos and don'ts on the Teachable platform (“Platform”) and the different rights and responsibilities for everyone (including us). Please make sure to read them, and if you're not certain about things, please drop us a line.
To be eligible for this Challenge, you must be on a paid Teachable plan (Basic, Pro, or Business).
At the start we want to make something very clear - this challenge is not a contest. We are not awarding prizes of monetary value. Rather we're challenging you to have your course ready for a pre-sale launch in one month or less! We want to see you succeed and this Challenge was created to help that mission.
Your participation in this Challenge also does not guarantee that you will succeed in generating more sales, making a sale, reaching a larger audience, or achieving any other measures of success for your business. All creators will succeed or fail at their own risk while using the Teachable Platform.
Some creators who complete the Challenge may be featured, along with their content, on the Platform. These features are independent of the Challenge itself and are in no way evidence of 'winning' the Challenge (honestly, by taking part, we're all winners). We always look to feature our creators who use our Platform to reach people in unique, memorable, and effective ways. In reality, whenever you offer content on our Platform - regardless of whether you participate in the Challenge - we may invite you to feature your content on our Platform.
All that said, in order for us to display your content on our Platform (in potentially a number of places online), we need to get a release from you up front that allows us to publish your content on our website and other places, and that allows us to do this publishing without having to get permission from you each time we do so. Further, we need you to agree that you are not being compensated for our display of your content, either for the original production or each time we subsequently publish it.
In legal terms, this means that by entering the Challenge, you agree to provide Teachable with an unconditional, irrevocable, non-exclusive, non-transferrable, worldwide license allowing Teachable to use your name, photograph, video, voice, business/trade names, course/lecture titles, and other likenesses, for publishing, blogging, promotional, advertising, trade, and other purposes in connection with the Challenge without further compensation to you. The license contemplated herein does not include your course content (if you are a Teachable creator), of which you retain all rights and ownership in alignment with Teachable’s Terms of Use and Privacy Policy.
As part of the Challenge, Teachable will share tools and expertise to assist you to build out the key marketing assets and foundation elements that you’ll need for your course to be ready for pre-sale in a month.
When you conduct a pre-sale, it’s very important to let your customers know that they are purchasing content that will not be available immediately. You therefore agree that if you launch your course as a pre-sale, you will include clear language on your sales page letting your audience know that you’re engaging in a pre-sale, as well as when your customers can expect to receive the services (your final course content). Additionally, the checkout page of your pre-sale course must clearly state that a customer’s 30 day refund window begins as of the date of sale, not the date that content is available.
In legal terms, this means that you agree to provide your customers with clear and conspicuous notice of all material terms of the offer, including that it includes a pre-sale, prior to purchase.
Furthermore, as a pre-sale seller, you, the creator, agree to indemnify and hold Teachable harmless for any and all costs or other losses (including but not limited to refunds, chargeback and other fees) incurred by Teachable in connection with your pre-sale course or a violation of this terms and conditions.
When a sale of the course you launch through this Challenge is processed through a Teachable Native Gateway (Teachable Payments or Monthly Payment Gateway), Teachable will place up to 50% of the sale in reserve for a period of time to cover losses, chargebacks, refunds, etc. The amount of reserves and the length of time in which they are held are subject to change at Teachable's sole discretion.
The Challenge and any material related thereto is offered on an “as-is” basis. Teachable does not offer any warranty of any kind, express or implied, or represents that the Challenge and any material related thereto will be free of errors or defects. The views and opinions expressed by sponsors and other participants in the Challenge are theirs alone and do not reflect the views and opinions of Teachable or its employees. Teachable does not endorse, and expressly disclaims, all liability relating to any advice, content, or other representations or services provided by sponsors or other participants. Teachable’s liability under these terms is further limited to the extent and amount provided for in Teachable’s Terms of Use.
Teachable may, in its sole discretion and without notice, amend these terms and conditions at any time.
